Terms of use
1. Who we are and what these terms cover
1.1 Onda is a platform for discovering and organising events, communities and plans in Tenerife, with real-time information about the vibe at venues. It is provided by pending: betreiber name, pending: anschrift, NIF pending: nif (“Onda”, “we”).
1.2 These terms govern the use of the Onda app, the event sharing pages and the website pending: domain. The Community guidelines are part of them. Business accounts are also subject to the Business terms. How we handle your data is explained in the Privacy policy.
1.3 Onda is in a test phase. Some features may change or fail, and payments are simulated (clause 7.2).
2. Minimum age and account
2.1 Minimum age. Onda is only for people aged 18 or over. When you sign up you confirm your year of birth. If an account belongs to a minor, we suspend it.
2.2 One person, one account. Your details must be true. Each person may have only one personal account. You may not impersonate another person, business or venue.
2.3 Security. Keep your password secret. If you think someone is using your account, change your password, end your sessions in Settings and let us know.
2.4 Leaving. You can delete your account at any time in Settings. Your content is anonymised (“Deleted account”).
3. What Onda offers
3.1 Free service. With Onda you can discover events and places, create events, RSVP, join communities, chat, report the vibe at a venue, redeem specials and get tickets. Use is free for users.
3.2 Joining without an account. Through a link you can RSVP or join a community without an account by entering a name. Your device stores a code to recognise you. As a guest you can only RSVP, cancel and join; for everything else you need an account. These terms and the community guidelines also apply to guests.
3.3 Third-party events. Whoever creates an event is its organiser and is responsible for it (date, place, permits, safety, age limit, price). Onda does not organise third-party events and does not guarantee that they take place as announced.
3.4 Availability. We try to keep Onda running at all times, but cannot guarantee uninterrupted availability, especially during the test phase.
4. Live vibe
The live vibe shows what a venue is like right now, based on what people there report. These are impressions of the moment, not facts verified by Onda or statements by the venue.
4.1 Only the current situation, from the place itself. Reports describe the current situation at the venue using the available states (crowd, queue, music, mood, entry) and, if you like, a short text of up to 80 characters. You can only report when you are nearby (we check that you are within 500 metres; your location is not stored). Free text is reviewed before it is published; until then only you can see it.
4.2 No accusations. The live vibe is not the place to accuse people or venues (for example of poor hygiene, drugs, violence, aggressive staff or licence breaches). If you want to warn about something like that, use Report: it goes to the Onda team, not to the public.
4.3 No identifiable people. Do not name or describe identifiable people (staff, door staff, DJs, guests) in the live vibe.
4.4 No manipulation. False reports, coordinated reports, using several accounts, votes in exchange for benefits and reports aimed at competitors are prohibited. Businesses may not vote on the vibe at their own venue.
4.5 How it is calculated. Each report has a weight based on the reporter’s reputation (new 0.5; regular 1; trusted 2; the venue itself 2, marked “from the venue”). A value appears as “unconfirmed” from weight 1 and as “confirmed” from weight 3 with at least two different people or after review by the team. Values expire 90 minutes after the last report; each confirmation extends them by 30 minutes, up to a maximum of 3 hours; each “Not true” shortens them by 30 minutes. If at least three people vote “Not true” and there are more votes against than in favour, the value is hidden automatically. These parameters can be adjusted per area; the current ones are published on this page.
4.6 Venue dispute. A claimed venue can dispute a value by giving a reason. The value is then marked “disputed by the venue” and reviewed by the team.
4.7 Reputation. You gain points when your reports are confirmed or your text is approved, and lose them when they are removed. Points determine your level and the weight of your reports. Reputation is not a rating of you as a person and has no effect outside the live vibe.
5. Your content
You are responsible for what you post (events, comments, photos, reviews, messages, reports). You may not post:
5.1 Spam: unsolicited advertising, repetitive content, misleading links or chain messages.
5.2 Inappropriate content: explicit sexual content, graphic violence, glorification of violence or incitement to hatred.
5.3 Harassment: harassing, threatening, intimidating or insulting other people.
5.4 False information: incorrect details about events, places, prices or specials.
5.5 Things that do not exist: made-up events or places.
5.6 Duplicates: more than one entry for the same event or place. Duplicates are merged.
5.7 Other people’s data and photos without their consent, in particular photos in which someone is recognisable who does not want to appear.
5.8 Illegal content, including content that infringes copyright, trade mark or image rights, or the reputation of people or businesses.
5.9 Licence. Your content remains yours. So that Onda can work, you grant us a free, non-exclusive licence, limited to the time it is published, to host it, display it on Onda and on the sharing pages, adapt it technically (for example resize a photo) and translate it automatically when someone asks (marked “machine translation”). The licence ends when you delete the content or your account, except for backups until they rotate and for anything we must keep by law.
5.10 No editing by us. Onda does not change the content of your texts. We may publish them, restrict their visibility or remove them in accordance with clause 6.
6. Moderation and measures
How we moderate. We review content when we receive a report (anyone can report with the Report button, even without an account) and, on our own initiative, the free text in the live vibe, which a person always reviews before publication. We use two automated tools: a word filter that rejects free vibe text containing names, accusations or insults before it is saved, and the automatic hiding rule based on votes in clause 4.5. All other decisions are taken by a person on the moderation team. When deciding, we act diligently, objectively and proportionately, taking into account the rights of everyone involved, including freedom of expression. The procedure is described on Digital services.
6.1 Measures. Depending on severity and repetition we may: approve or reject a text, hide or remove content, remove a vibe report, reduce reputation, warn you, suspend your account temporarily or, for serious or repeated violations, indefinitely. Moderators can suspend for up to 30 days; longer suspensions are decided by Onda’s administration.
6.2 Review and restoration. You can complain about any decision free of charge for at least six months by writing to pending: email dsa with the case number. A person, where possible different from the one who decided, reviews the complaint and usually replies within 14 days. If the decision was not justified, we reverse it and restore the content or account. People who reported something can also complain if we did not act.
6.3 Reasons. We explain every measure that affects you: what we decided, its scope and duration, the facts, whether it followed a report or our own initiative, whether automated means were involved, the clause or law applied and your options for redress (Article 17 of Regulation (EU) 2022/2065). We never tell you who reported.
6.4 Other routes. You can always go to court. You can also lodge a complaint with the Comisión Nacional de los Mercados y la Competencia (CNMC), the Digital Services Coordinator in Spain.
6.5 Authorities. We comply with orders from competent authorities. If we have indications of a crime threatening the life or safety of people, we inform the authorities immediately (Article 18 of Regulation (EU) 2022/2065).
7. Specials and tickets
7.1 Specials. Specials are published by each venue, which sets the conditions and is responsible for honouring them. Each redemption code is valid once and for 90 seconds. Improper redemption (for example with several accounts, for other people when the special is personal, or by reselling codes) is prohibited, as is publishing misleading specials.
7.2 Tickets. During the test phase tickets and payments are simulated: no money is charged and the ticket does not grant entry unless the organiser expressly says so. Before real payments go live, we will tell you who sells the ticket, the price including taxes and the organiser’s cancellation terms. For tickets to leisure activities on a specific date there is no right of withdrawal (Article 103(l) of the Spanish consolidated General Law for the Protection of Consumers and Users).
7.3 Organisers. If an event is cancelled, the organiser decides on refunds according to its terms and the law.
8. Businesses and venue claims
8.1 Claiming a venue. A business may claim the management of a venue on Onda if it shows that it operates it (for example with its website, Instagram, a business email or the licence). A person on the Onda team reviews the evidence.
8.2 One venue, one business. Each venue can be assigned to only one business, and only one claim per venue can be open at a time.
8.3 Further rules for businesses are in the Business terms.
9. Recommendations and ordering
9.1 Without personalised recommendations, we sort events by date, chosen area and general popularity. If you turn on “For you”, we sort them by your interests (main weight), how soon they are, distance and recent popularity; “Not interested” immediately reduces similar suggestions. You can turn it off in Settings.
9.2 If there is sponsored content in future, it will be labelled “Sponsored”. Payment has no influence on the live vibe.
10. Liability
10.1 Onda hosts third-party content and is not liable for it as long as it has no actual knowledge of its illegality; as soon as it does, it acts quickly (Article 16 LSSI and Article 6 of Regulation (EU) 2022/2065).
10.2 Onda is liable in accordance with the law for damage caused intentionally or through gross negligence, for personal injury and for the rights granted to you by consumer law. Nothing in these terms limits those rights.
10.3 The live vibe and the information on events and specials are for guidance. Before making an important decision (for example a long journey), check the information with the organiser or the venue.
10.4 You are liable in accordance with the law for damage you cause by breaching these terms.
11. Term and termination
11.1 The contract runs for an indefinite period. You can end it at any time by deleting your account.
11.2 We can end it with 30 days’ notice, or without notice in the event of a serious or repeated breach, always explaining the reasons in accordance with clause 6.3.
12. Changes to these terms
If we change these terms significantly, we will notify you in the app or by email at least 15 days before they apply. If you do not agree, you can delete your account before that date. Previous versions remain available on request.
13. Languages
These terms are available in Spanish, English and German. The Spanish version is the original; the others are translations. Where there is doubt about interpretation, it will not be resolved to your detriment as a consumer.
14. Applicable law and courts
Spanish law applies. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of your country. For disputes with consumers, the courts of the consumer’s place of residence have jurisdiction.
15. Contact
